The Gambling Commission in Britain can prevent pubs from providing gambling services to consumers even if those pubs satisfy the criteria necessary for obtaining an operating licence, – the Court of Appeal in London has confirmed.
The UKGH has begun a legal battle after the gaming regulator decided to reject its application for a bingo license. Greene King, UK’s largest pub retailer and brewer, argued that their project satisfied the regulators’ norms of gaming permissions.
The initial legal challenge by Greene King was successful, however the case was referred to the Court of Appeal for summary judgment after the UKGC lodged an appeal. The Court of Appeal supported the UK Gambling Commissions argument, stating that the UKGC was entitled to consider and find the proposed operation of that licence to be inconsistent with the licensing objective and refuse that licence accordingly.
