Spain has temporarily banned access to the prediction markets Kalshi and Polymarket, joining a growing list of countries that ban these platforms viewing them as facilitating illegal gambling. The decision by Spain’s Consumer Rights Ministry follows disciplinary proceedings initiated against both companies for alleged violations of gambling regulations.
The ministry announced the blocking of both websites within Spain as a precautionary measure while the investigation continues. In a statement, the ministry explained:
“The Consumer Affairs Department has ordered the blocking of both websites within Spain as a precautionary measure until the final resolution of the proceedings.”
The ministry argues that prediction markets constitute gambling when bets are placed on uncertain outcomes. Therefore, operating in Spain requires a specific administrative license, which neither Kalshi nor Polymarket currently holds. The statement also pointed out that these platforms lack essential safeguards, such as identity verification, controls to prevent access by minors, and adequate mechanisms to protect users.
Spain’s move follows similar actions taken by other countries, including Italy, France, Germany, Belgium, Hungary, New Zealand, Brazil, Romania, Portugal, Australia, Argentina, and Indonesia. While some nations have banned both platforms, others have specifically targeted Polymarket.
Despite the global regulatory crackdown, U.S. President Donald Trump has publicly supported prediction markets, emphasizing the importance of maintaining the Commodity Futures Trading Commission’s (CFTC) exclusive authority over them. This stance contrasts with the international trend of restricting access to these platforms.
In the U.S., the House Oversight Committee is investigating allegations of insider trading on prediction markets. Legal debates continue over whether states have the authority to regulate the types of events that can be traded on these platforms. The uncertainty surrounding their legal status adds to the challenges faced by Kalshi and Polymarket as they navigate a rapidly changing regulatory landscape.
