Michigan Takes Legal Action Against Kalshi Over Sports Contracts

Dana Nessel, Michigan’s Attorney General, has filed a lawsuit against prediction market platform Kalshi. The state wants to stop Kalshi from offering sports-related event contracts to Michigan residents.

The lawsuit claims Kalshi operates unlicensed sports betting in the state. “These contracts function as gambling,” Nessel argues. The state seeks a permanent injunction to block Kalshi’s sports offerings.

Michigan joins nine other states battling Kalshi in court. States choose state courts deliberately. They want to avoid Kalshi’s federal preemption arguments. Federal courts might rule that federal law supersedes state gambling regulations.

Massachusetts set an important precedent. The state won a preliminary injunction against Kalshi in January 2026. Nevada also scored a victory. A court returned their case to state court, rejecting federal jurisdiction.

Meanwhile, Kalshi faces federal pushback. Polymarket filed a federal lawsuit against Michigan. The company seeks to block state enforcement actions. Robinhood also launched federal litigation against state regulators.

Michael Selig, Chair of the Commodity Futures Trading Commission (CFTC), weighs in on the debate. He asserts federal authority over prediction markets. Selig plans to create clearer regulatory frameworks for these platforms.

The conflict highlights growing tension between state gambling laws and federal financial regulations. Prediction markets allow users to bet on real-world events. These include sports games, elections, and economic indicators.

Kalshi operates under CFTC oversight as a regulated exchange. However, states argue sports contracts violate local gambling laws. The platform claims federal authorization shields it from state restrictions.
